What is the California Lemon Law? Not being an attorney, I can only answer that through examples and sharing from my human perspective.
Also, with not being an attorney, I sometimes wonder what I have a right to and what I don't when it comes to the law. And I'm sure, if you aren't an attorney, you wonder the same thing.
So when it comes to this California law, I feel an obligation to share testimonies of people I know or know of that have found a way to make sure that Goliath, the gigantic car manufacturers, does not stomp on the little guy; us. The California Lemon Law does just that; it makes a legal way for consumers like you and me to fight back. Also, I find that writing articles that will help others in situations like the one below is what I do in hopes that someone will read them and know how to proceed if they ever have an issue with their vehicle.
If you live in California, you should be aware that you have a right to dispute and legally pursue a remedy if you feel you purchased a "lemon" when you bought your vehicle. The law that was put into place to protect consumers is the California Lemon Law.
I came face to face with this law when a friend of my brother's, Daniel, purchased a $40,000 stick shift sports car and had it in the dealership's repair shop not even a week later.
What was the problem with the car? Plain and simple; it wouldn't shift into gear. The gear shift was stuck and you couldn't get it into reverse; first gear; nothing. He was beside himself. What an unfortunate situation; he just purchases an expensive car and he can't drive it.
The first time he brought it to the dealership to be repaired, they called him shortly after and said that it was fine and that he could pick it up. At this point, it was just a repair so he didn't even think of the California Lemon Law, because he never thought he actually had a "lemon."
Several days later, the same thing happened again. He made another call to the dealership and once again, he brought it in to be repaired. When the third time came around, it definitely wasn't the charm. He knew that this car was never going to operate correctly, so he did some investigating online and discovered that he could get a free evaluation to find out if he qualified to put in a claim through a California attorney.
Well, Daniel did qualify and a very knowledgeable attorney who specializes in the California Lemon Law represented him. In a short amount of time, he got reimbursed for all his time and trouble and was able to get himself a new and perfect car.
Moral of the story: do not wait if you think your car is a lemon. Get a free evaluation from an attorney that specializes in this law today. Hopefully your situation will finish with a happy ending the same as Daniel.
